When is a search not a search? Back in the day, American Colonists did not like that the English government would be allowed to search their homes at any point,, and search their property. When America was born the people made sure to voice their opinions to have the constitution protect them from unwarranted search and seizure. Thus lead to the Fourth Amendment. The Fourth Amendment now protects Americans from unwarranted search and seizures. But is using new advanced technology to scan a home still searching? In the DLK case the government used a thermal imager to scan the house for excessive amounts of heat sources to gather further evidence that he was illegally growing marijuana. Is this violating DLK’s Fourth Amend,ent rights? Did the government go too far in “searching” DLK’s house without a warrant? The government did not go to far in violating DLK’s Fourth Amendment rights by using the thermal imager.
